Terms & Conditions

These terms explain how ordering from us works, what you can expect from us, and what we ask of you. They sit alongside our Refund & Cancellation Policy, Shipping Policy and Privacy Policy.

1. About these terms

These terms apply when you browse this website or place an order with Delight Baker. By placing an order you agree to them, so please read them before you buy.

We may update these terms from time to time. The version published on this page at the moment you place your order is the version that applies to that order.

2. Placing an order

When you place an order you are making an offer to buy. Your order is accepted only when we send you an order confirmation by email. If we cannot accept your order — for example if we cannot meet your delivery date, or a product is unavailable — we will tell you and refund you in full.

You are responsible for the accuracy of the details you give us, particularly the delivery address, delivery date and any personalised message on the cake. We bake and pipe exactly what is submitted, so please check your order carefully before paying.

3. Our cakes

Every cake is handmade, so no two are identical. Photographs on this website show examples of our work and are intended to represent the design, finish and general appearance of the cake you will receive. Small variations in shade, decoration and finish are a normal part of hand-decorated work and are not a fault.

Colours can also appear differently depending on your screen. If exact colour matching matters for your event, please contact us before ordering so we can advise.

Where a design is based on a photograph or reference you supply, you confirm you have the right to use that image and that it does not infringe anyone else's copyright or trade marks.

4. Prices and payment

Prices are shown in pounds sterling and include VAT where applicable. The price you pay is the price displayed at the moment you place your order.

Sponge, filling and dietary options may carry an additional charge. Where they do, the charge is shown on the product page before you add the cake to your basket and again in your basket, so nothing is added at checkout that you have not already seen.

Delivery is charged separately and is shown in your basket and at checkout before payment. Payment is taken in full at the time of ordering, through Shopify's secure checkout. We never see or store your full card details.

5. Delivery

We deliver within the United Kingdom. UK delivery is a flat £6.99 on every order, shown in your basket and at checkout before you pay.

Delivery dates are the date you select on the cake page when ordering. While we work hard to meet every date, delivery times quoted by our couriers are estimates and we are not liable for delays caused by weather, traffic or other events outside our reasonable control. If a delay is within our control, your rights are set out in our Refund & Cancellation Policy.

Someone must be available to accept the cake at the address and time slot you chose. Cakes are perishable and cannot safely be left unattended.

6. Cancellations and refunds

Because our cakes are freshly baked to your specification, cancellation rights are limited. Your full rights, the cancellation windows, and what to do if an order arrives damaged are set out in our Refund & Cancellation Policy, which forms part of these terms.

7. Allergens and food safety

Our kitchen handles nuts, eggs, dairy, gluten and soya. We cannot guarantee that any product is free from traces of these allergens, even where a dietary option has been selected. If you or a recipient has a food allergy, please contact us before ordering.

Cakes should be stored as advised on delivery and consumed by the date we give you. We cannot be responsible for a product that has been stored incorrectly after it has been delivered.

8. Our liability to you

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of that failure. We are not responsible for loss or damage that is not foreseeable.

We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud, and for any breach of your legal rights in relation to the products we supply.

We supply our products for domestic and private use. We are not liable for loss of profit, loss of business or business interruption.

9. Website content

The text, photographs, designs and branding on this website belong to us or our licensors and are protected by copyright and trade mark law. You may use this website for your own personal, non-commercial use. You may not copy or republish our content without our written permission.

10. Complaints and your rights

If something has gone wrong, please contact us first — we would much rather put it right directly. Our contact details are below and we aim to respond within two business days.

Nothing in these terms affects your statutory rights as a consumer under the Consumer Rights Act 2015.

11. Governing law

These terms are governed by the law of England and Wales, and any dispute will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
